The Role Responsibilities

Job Summary

The Legal Counsel, Indonesia for nexus Indonesia is a key member of the Indonesia Legal team, to execute on the strategy for legal support in Indonesia, particularly within CPPB (Consumer, Private & Business Banking) business and nexus Indonesia team. This role looks to enable the nexus business to achieve its strategies and targets, whilst also being a trusted gatekeeper for the Bank. This role will provide legal support and advice to the nexus business, and build a strong focus/alignment with the nexus Indonesia team to the Country CEO and the Country Leadership Team. The person will also promote a culture and practice of good conduct of business and adherence to legal standards within the Bank.

Responsibilities

Strategy
  • Key member of Legal Indonesia, to execute the strategy for legal support of Indonesia, particularly within CPPB business and Nexus.
  • Define the strategy for legal support of the nexus Indonesia business, with overarching accountability to Country Head of Nexus Indonesia and Country Head Legal Indonesia for this business.
  • Work closely with the leadership team for the business to anticipate and mitigate legal risks.
  • Provide proactive strategic legal advice and support to the Country Head of Nexus Indonesia and Country CEO on key technology and commercial issues across Indonesia nexus business, working with the CPBB Legal, Nexus Legal team in Singapore and Country Head Legal as appropriate.
  • Be accountable as a point of escalation for any material legal issues pertaining to nexus Indonesia business.
  • Support Head of Legal Indonesia, in embed a Here for Good culture in the Indonesia Legal team and comply with (and endeavour to ensure the Indonesia Legal team complies with) the Group Code of Conduct.
  • Follow the Group Management Responsibility Policy to ensure effective risk management and the implementation of proper controls across the Indonesia Legal team.
  • Demonstrate knowledge of all relevant aspects of laws and regulations relating to the nexus business, particularly with respect to data privacy, cloud computing, intellectual property and regulatory matters, whilst advising on strategies with the nexus business.
Business
  • Be accountable for and have primary responsibility over the legal support and advice for nexus Indonesia business, including product and customer transactions, technology and commercial transactions, ongoing vendor and contract management issues working with the nexus Legal Lead, Country Head of Legal, the broader legal team and external Legal Counsel as appropriate.
  • Ensure legal support is made available for all other legal matters impacting nexus Indonesia business, including disputes and regulatory/government investigations.
  • Work with the nexus Indonesia team to ensure projects, transactions and initiatives under nexus Indonesia business have the necessary legal and regulatory clearances and are consistent with the Bank’s standards.
  • Partner with other members of the Legal function and contribute to legal matters generally impacting Indonesia given close interdependency of the nexus business and incumbent businesses in Indonesia.
Processes
  • Support the Country Head of Legal Indonesia and Country Head of Nexus in developing effective processes (including training, advice and support) to ensure that relevant policies and standards are effectively implemented.
  • Where external counsel is appointed, liaise with external counsel and ensure the scope of work is defined and appropriate, oversee the quality of work and manage external legal costs and ensure appropriate overall matter management.
  • Manage the Legal annual budget and forecasts insofar as it relates to the nexus Indonesia business.
  • Contribute to and execute organisational design strategies consistent with Indonesia’s target operating model and the target operating model of nexus Indonesia.
People & Talent

  • Drive best practices and lessons learned across the network and create and provide training on legal issues to the business and Country Leadership team.

  • Engage relevant stakeholders (client segment/product business teams, regulators, other infrastructure and governance functions, and Legal and Compliance colleagues at Group, regional and country level) to obtain continuous feedback on personal performance.
Risk Management
  • Anticipate, identify, mitigate, monitor and report legal risks in relation to the nexus Indonesia business as required by the relevant risk management frameworks, working with the nexus Legal Lead and Country Head of Legal as appropriate.
  • Be the Risk Control Owner for Legal Enforceability Risk arising in nexus Indonesia business.
  • Where relevant, be the Process Owner for any country processes relating to nexus Indonesia business and where such processes are executed by the Legal Function. Be responsible for the management of such processes in line with the relevant process universe and associated risks, including activities within the processes which are carried out by the business or other functions, or which are hubbed or outsourced.
  • Effectively and collaboratively identify, escalate, mitigate and resolve other risks, conduct and compliance matters, working with the nexus Indonesia team.
Governance
  • Review and proactively contribute in any papers being tabled by Legal at country governance committees, and clearly articulate the issues and legal risks involved and any mitigants approved (as appropriate).
  • Proactively learning and contribute, to ensure that policies, procedures and standards addressing legal risk are effectively implemented across the country Legal team.
  • Have an awareness and understanding of the regulatory framework in which the Group operates, and the regulatory requirements and expectations relevant to the role.
  • Support effective management of legal matters across Indonesia.
  • Work with local regulators (when required) in an open and cooperative manner.
Regulatory & Business Conduct

Our Ideal Candidate
  • Qualified to practice as a solicitor/attorney or barrister/advocate with a minimum of 10 years’ post qualification experience
  • Experience in private practice or in-house of managing complex legal issues
  • Sharp business acumen (including ability to assess risk and appropriate levels of return), strong leadership qualities, excellent interpersonal skills and multi-cultural awareness and sensitivity
  • Have good knowledge and experience on technology law and financial technology
